Jury Nullification
0 Views
It is a little-known fact that when a jury believes that a law has been applied erroneously, or that the law is immoral, the jury may return a verdict of ”not guilty,” even if they believe the defendant is guilty. This, in effect, nullifies the law for the purposes of that trial and is known as jury nullification. It is also known as ”the people’s veto power.” Most courts do not make jurors aware of this right, but it exists to this day.
