What to say to the police while being investigated
“If you are being investigated by the police, you should not talk to them before you consult a lawyer. If the police are investigating you, they will talk to you only if they don’t have enough evidence to charge you. Always be polite and calm when talking to the police, even if they’re not polite to you, because you have rights, and the most important one is to have an attorney who’s on your side to advise you when you are interviewed by police. You should tell them your name, but they are not entitled to ask you anything else if you tell them you wish to have a lawyer advising you prior to and during any questioning. Police will tell you that you should not get a lawyer, that if you take time to consult a lawyer, the case will be filed and it will be too late to tell anyone your side of the story. This is a lie. The law allows them to lie to you, to trick you into telling them what they need to know to put you in jail. The more they pressure you to talk without a lawyer, the more you can be sure a lawyer is just what you need. The Sixth Amendment to the Constitution protects citizens and non-citizens. It says that you have the right to a lawyer before you talk to the police, and the police are required to provide you an attorney if you cannot afford one before you talk to them.”
